CONSENT WITH PERSONAL DATA PROCESSING

In accordance with Art. 6 par. 1 letter a) of Regulation (EC) No 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR") (hereinafter referred to as "Consent") as the person concerned, I agree with the processing of my personal data by:

The withdrawal of the Consent does not affect the legality of the processing based on the Consent prior to its withdrawal. If I withdraw the Consent, my personal data thus provided cannot be more processed by the Controller if there is not a different legal basis for subsequent processing.

Who do we disclose your personal data to?

We disclose personal data of our clients and other natural persons only to the extent necessary and always with the confidentiality of the recipient of the data eg. to our employees, to the persons we entrust to carry out individual acts of legal services, to cooperate attorneys, to our accounting and tax advisors, to the Slovak Bar Association (eg. in the case of disciplinary proceedings) or to the provider of software or support of our office, including the employees of these persons.

Despite the fact that we have limited obligation to disclose your personal information to public authorities for the sake of confidentiality, we are obliged to break the offense, and we also have the obligation to report on the prevention of money laundering (money laundering and terrorist financing).

In certain cases, the personal data of clients or other natural persons can be published. These are cases of cadastral proceedings, proceedings on registration in the Commercial Register, proceedings on the registration of a lien in the Notary Central Register of Pledge, proceedings on registration of rights in registers kept by the Industrial Property Office of the Slovak Republic, etc. However, this is always done on the basis of a special regulation and in the provision of legal services.

To which countries do we transfer your personal data?

No cross-border transfer of your personal data to third countries outside the European Economic Area (EU, Iceland, Norway and Liechtenstein) is performed.

We do not automate individual decision making, including profiling.

How long do we keep your personal data?

We keep your personal information as long as necessary for the purpose. When storing your personal data, we follow specific regulations that set us the terms of deposit and/or the basic principles of GDPR regarding the retention and disposal of personal data.

How do we collect your personal data?

If you are our client, we often get your personal information directly from you. Depending on the particular case of non-provision of personal data by clients, our ability to provide quality legal advice is limited and in exceptional cases we are obliged to refuse to provide legal advice. We may also obtain personal information about our clients from publicly available sources, from public authorities or from others.

If you are not our client, we often receive your personal information from our clients or from other public or legal sources such as by requesting public authorities, obtaining evidence for the benefit of the client, extracting from public registers, inspecting administrative, judicial or other files and/or registers maintained by public authorities, etc. In such a case, we may obtain personal information about you without your knowledge and on the base of our legal authority and obligation to practice the advocacy in accordance with the law.

What rights do you have as data subject?

As data subject, you have following rights:

  • the right to withdraw the consent to the processing of personal data

If we process personal data about you solely on the basis of your consent to the processing of personal data (Article 6 para. 1 letter a) of GDPR), you have the right to withdraw your consent at any time. The withdrawal of consent does not affect the legality of the processing based on consent prior to its withdrawal. If you withdraw this Consent, the Controller shall terminate the processing of such personal data without undue delay if there is no other legal basis for its subsequent processing.

  • the right to object to the processing of personal data for the purpose of direct marketing

At any time, you have the right to object to the processing of personal data for the purposes of direct marketing or if we process personal data on the basis of a legitimate interest under Art. 6 para. 1 letter f) GDPR.

  • the right to repair

As the person concerned, you can request us to correct inaccurate or incomplete personal data we process about you.

  • the right of access

As data subject, you have the right to request access to personal data we process about you.

  • the right to deletion

As data subject, you can request us to delete your personal data if:

(i) personal data are no longer necessary for the purposes for which they were obtained;

(ii) we process personal data solely on the basis of your consent that you withdraw;

(iii) you object the processing performed in specific situations under the GDPR (the public interest role, the Controller's legitimate interest or profiling) and your legitimate interests, rights and freedoms are not justified by any legitimate reasons for processing;

(iv) you object to processing for direct marketing purposes;

(v) personal data has been processed illegally;

(vi) personal data must be deleted in order to comply with a legal obligation under EU law or the Member State to which the Controller is subject;

(vii) personal data are collected in connection with the offer of services of information company under GDPR.

  • the right to portability

You have the right to transfer your personal data if we process your personal data based on:

 (i) your consent or

(ii) this is necessary for the performance of the contract to which you are a party;

in case of automated processing means, you have the right to request the transfer of personal data to another controller. This applies if you have provided personal data to the Controller in a structured, commonly used and machine-readable format and this right does not adversely affect the rights and freedoms of others.

  • the right to complain

You have the right to file a complaint to the supervisory body, which is the Office for Personal Data Protection of Slovak Republic, Hraničná 12, 820 07 Bratislava 27, www.uoou.sk.
